Important Notice: Please read these Terms of Service carefully before using MyLog. By creating an account or using our service, you agree to be bound by these terms. If you do not agree, do not use MyLog.
1. Acceptance of Terms / Te Whakaae ki ngā Ture
These Terms of Service (“Terms”) constitute a legally binding agreement between you and MyMate Limited (NZBN: 9429052964442), a company registered in New Zealand, governing your use of the MyLog service.
By using MyLog, you agree to:
- These Terms of Service
- The Disclaimer
- Our Privacy Policy (incorporated by reference)
- All applicable laws and regulations of New Zealand
If you are using MyLog on behalf of another person (as a caregiver or family member), you represent that you have legal authority to bind that person to these Terms.
2. Definitions / Ngā Whakamāramatanga
For the purposes of these Terms:
- “MyLog,” “we,” “us,” “our”: MyMate Limited and the MyLog service
- “You,” “your,” “user”: Any person who accesses or uses MyLog
- “Family Admin”: The person who creates and manages a family account
- “Family Member”: A person authorized by the Family Admin to access the family’s diary
- “Caregiver”: A support worker authorized by the Family Admin to access and contribute to the diary
- “Person Supported”: The individual with a disability whose daily experiences are recorded in MyLog
- “Service”: The MyLog platform, website, and all related services
- “Content”: All diary entries, photos, notes, and information entered into MyLog
- “Account”: Your registered user profile and access credentials
3. Service Description / Te Whakamārama Ratonga
3.1 What MyLog Is
MyLog is a private online diary platform designed to help people with disabilities and their support networks record daily experiences, preferences, moods, activities, and continuity notes.
MyLog provides:
- A secure, private space for recording daily observations
- Ability to upload photos and notes
- Shared access for authorized family members and caregivers
- A continuous record of daily life and preferences
- Communication and continuity tool between family and support workers
3.2 What MyLog Is NOT

MyLog is NOT monitored by healthcare professionals or emergency services.
NEVER use MyLog to report medical emergencies.
For emergencies, ALWAYS call 111 immediately.
MyLog is NOT:
- ❌ A medical record or clinical documentation system
- ❌ A substitute for professional medical advice, diagnosis, or treatment
- ❌ A replacement for formal disability support service documentation
- ❌ An emergency response or crisis management system
- ❌ A medication management or tracking system
- ❌ A replacement for care plans required by funding agencies (e.g., Ministry of Health, ACC, NASC)
- ❌ Compliant with formal agency reporting requirements
- ❌ A secure messaging or communication platform for urgent matters
3.3 Intended Use
MyLog is intended as a supplementary personal tool to enhance continuity and communication. It does not replace:
- Formal support agency documentation systems
- Clinical or medical records
- Incident reporting systems
- Medication administration records
- Legal or official documentation required by funders
4. Eligibility and Account Registration / Te Kaitono me te Rēhita Pūkete
4.1 Age and Capacity Requirements
To create a MyLog account, you must:
- Be at least 18 years of age
- Have legal capacity to enter into binding contracts under New Zealand law
- If creating an account on behalf of another person, have legal authority to do so
Legal Authority Requirements:
For Children Under 16:
- You must be the child’s parent or legal guardian
For Adults Who Lack Capacity:
- You must have legal authority through:
- Enduring Power of Attorney (Personal Care and Welfare), OR
- Welfare Guardian appointed under the Protection of Personal and Property Rights Act 1988, OR
- Other lawful legal authority
For Adults With Capacity:
- You must obtain their informed consent before recording or sharing their information
Documentation:
- We may require you to provide evidence of your legal authority if questions arise
4.2 Account Creation
When you register for MyLog:
- You must provide accurate, current, and complete information
- You must maintain and promptly update your account information
- You are responsible for maintaining the confidentiality of your password
- You are responsible for all activities under your account
- You may not share your login credentials with others
- You may not create multiple accounts for the same family
4.3 Account Types and Roles
Family Admin:
- Creates and manages the family account
- Invites and removes Family Members and Caregivers
- Manages subscription and billing
- Has full access to all diary entries
- Can delete the entire account
Family Member:
- Must be invited by Family Admin
- Can view and create diary entries
- Cannot invite others or manage billing
Caregiver:
- Must be invited by Family Admin
- Can view and create diary entries
- Cannot invite others or manage billing
- Access can be revoked by Family Admin at any time
When Caregiver Access is Revoked:
- Caregiver immediately loses all access to the diary
- Caregiver must NOT retain any copies of diary information
- Caregiver must delete any notes or records derived from MyLog access
- Caregiver has no ongoing rights to the information
4.4 Account Security
You must:
- Use a strong, unique password
- Never share your password
- Log out when using shared or public devices
- Notify us immediately of any unauthorized access: info@mylog.co.nz
- Accept responsibility for all activities under your account
4.5 Account Termination by You
You may terminate your account at any time by:
- Accessing your Account settings and selecting “Delete Account”
- Contacting us at info@mylog.co.nz
Upon termination:
- Your access will be immediately revoked
- All diary entries and photos will be permanently deleted within 30 days
- Some information may be retained as required by law (see Privacy Policy)
- Paid subscriptions are non-refundable except as required by New Zealand consumer law
5. User Responsibilities and Acceptable Use / Ngā Takohanga Kaiwhakamahi
5.1 Your Content Responsibilities
You are solely responsible for all Content you create, upload, or share through MyLog.
You agree that all Content you post:
- Is accurate to the best of your knowledge
- Does not violate any laws or third-party rights
- Is appropriate for a care and support context
- Respects the dignity and privacy of the Person Supported
5.2 Consent and Authorization
CRITICAL REQUIREMENT:
By using MyLog to record information about a Person Supported, you represent and warrant that:
- You have obtained appropriate consent from the Person Supported (or their legal guardian/representative) to record and share this information
- The Person Supported (or their representative) understands who will have access to the diary
- You have legal authority to grant access to Family Members and Caregivers
- All invited Caregivers are authorized to access this information
If you are a Caregiver:
- You confirm you have been properly authorized by the Family Admin
- You will only access information necessary for providing support
- You will respect the privacy and confidentiality of the Person Supported
- You will comply with your employer’s policies (if applicable)
5.3 Prohibited Uses
You may NOT use MyLog to:
Content Violations:
- Post false, misleading, or defamatory information
- Share information about someone without proper authorization
- Upload illegal, abusive, harassing, or discriminatory content
- Post sexually explicit or pornographic material
- Share content that violates intellectual property rights
System Violations:
- Attempt to gain unauthorized access to other families’ data
- Interfere with or disrupt the service or servers
- Use automated systems (bots, scrapers) without permission
- Reverse engineer, decompile, or hack the service
- Introduce viruses, malware, or harmful code
Misuse:
- Use MyLog for any unlawful purpose
- Impersonate another person or entity
- Harass, threaten, or abuse other users
- Share login credentials with unauthorized persons
- Use the service in a way that violates these Terms
5.4 Professional Obligations
If you are a professional support worker or caregiver:
- MyLog does not replace your professional or employer obligations
- You must continue to follow your agency’s documentation requirements
- You must comply with your employer’s policies and procedures
- You remain bound by professional codes of conduct
- You are responsible for determining what can appropriately be shared in MyLog versus formal systems
6. Intellectual Property Rights / Ngā Mōtika Rawa Hinengaro
6.1 MyLog’s Intellectual Property
MyLog and all related materials (website, logo, design, code, functionality) are owned by MyMate Limited and protected by New Zealand and international copyright, trademark, and other intellectual property laws.
Trademark Notice:
“MyLog”™ and “MyMate”™ are trademarks of MyMate Limited. Common law trademark rights are claimed. These marks are not registered trademarks.
You may NOT:
- Copy, modify, or distribute our code or design
- Use our name, logo, or trademarks without written permission
- Create derivative works based on MyLog
- Remove or alter any copyright or proprietary notices
6.2 Your Content Ownership
You retain ownership of all Content you create in MyLog.
By using MyLog, you grant us a limited license to:
- Store and display your Content within the service
- Make backup copies for data protection
- Process your Content as necessary to provide the service
We do NOT:
- Claim ownership of your diary entries
- Use your Content for marketing or any purpose beyond service delivery
- Share your Content with third parties (except as described in Privacy Policy)
This license terminates when you delete Content or close your account.
6.3 Feedback and Suggestions
If you provide feedback, suggestions, or ideas about MyLog, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate that feedback without compensation or attribution.
7. Subscription Plans, Billing, and Payments / Ngā Mahere Ohauru, Pire, me ngā Utu
7.1 Subscription Plans
MyLog offers multiple subscription tiers:
- Free Plan: Limited features (1 Family Admin, 1 Caregiver)
- Basic Plan: Monthly or annual subscription with enhanced features
- Premium Plan: Monthly or annual subscription with full features

7.2 Billing and Payment
Payment Processing:
- All payments are processed securely through Stripe, Inc.
- We do not store your credit card information
- You must provide accurate billing information
- All prices are in New Zealand Dollars (NZD)
- GST: We are not currently GST registered. Prices do not include GST. If we become GST registered in the future, we will notify you and prices may change to reflect GST.
Subscription Billing:
- Monthly Plans: Billed on the same day each month
- Annual Plans: Billed once per year on the anniversary of your sign-up
- Your subscription automatically renews unless cancelled
- You will receive email notification before each renewal
Tax Invoices:
- Payment receipts are automatically emailed after each payment
- Available in Account Settings → Billing History
- Include: Date, amount, transaction ID
7.3 Price Changes
- We may change subscription prices at any time
- Price changes will not affect your current billing period
- You will be notified at least 30 days before any price increase
- If you do not agree to the price change, you may cancel before it takes effect
7.4 Cancellation and Refunds
Cancelling Your Subscription:
- You may cancel your subscription at any time through Account settings
- Cancellation takes effect at the end of your current billing period
- You retain access until the end of the paid period
- After cancellation, your account reverts to the Free plan (if available) or is deactivated
Refund Policy:
Subject to your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986, subscription fees are generally non-refundable.
Consumer Law Rights:
Under New Zealand consumer law, you are entitled to refunds if:
- The service is not provided with reasonable care and skill
- The service is not fit for the particular purpose you required
- The service is not completed within a reasonable time
- We have engaged in misleading or deceptive conduct
If you believe you are entitled to a refund under consumer law, please contact us at info@mylog.co.nz.
Discretionary Refunds:
We may provide refunds at our sole discretion for exceptional circumstances outside of your consumer law rights.
7.5 Failed Payments
- If payment fails, we will attempt to process it again
- You will be notified via email
- If payment fails repeatedly, your subscription may be suspended or downgraded
- You remain responsible for outstanding charges
8. Service Guarantees and Limitations / Ngā Tūtohunga me ngā Herenga
8.1 Your Rights Under New Zealand Consumer Law
Nothing in these Terms limits or excludes your rights under New Zealand consumer protection laws, including:
- Consumer Guarantees Act 1993: Services must be provided with reasonable care and skill, fit for purpose, and completed within a reasonable time
- Fair Trading Act 1986: Protection against misleading or deceptive conduct
- Other mandatory consumer rights
These rights cannot be excluded or restricted by contract.
8.2 Our Service Commitment
Subject to your consumer law rights, we commit to:
- Providing MyLog with reasonable care and skill
- Making reasonable efforts to keep the service available
- Protecting your data with appropriate security measures
- Responding to support requests within a reasonable timeframe
However, we do not guarantee that:
- The service will be available 100% of the time without interruption
- All software bugs will be immediately corrected
- Data storage will be completely immune to all technical failures
- The service will meet every specific requirement you may have
8.3 Limitation of Liability (Subject to Consumer Law)
To the maximum extent permitted by law, and subject to your rights under the Consumer Guarantees Act 1993 and other consumer protection laws:
We shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, or business opportunities
- Loss of data (see backup recommendations in Privacy Policy)
- Reliance on information in MyLog for medical or clinical decisions
- Actions or omissions of other users
- Interruption or suspension of service due to circumstances beyond our reasonable control
Maximum Liability Cap:
Subject to mandatory consumer law, our total liability for any claim shall not exceed the lesser of:
- The amount you paid us in the 12 months prior to the event, OR
- NZD $100
Consumer Law Protection:
This limitation does not apply to:
- Death or personal injury caused by our negligence
- Liability that cannot be excluded under the Consumer Guarantees Act 1993
- Liability for fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded under New Zealand law
8.4 No Medical or Professional Advice
MyLog does not provide medical, clinical, therapeutic, or professional advice of any kind. We are not healthcare providers. Nothing in MyLog should be construed as medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare professionals.
8.5 Third-Party Services
- We use third-party services (hosting, payment processing) that are beyond our control
- We are not responsible for failures or issues caused by third-party services
- Third-party services have their own terms and privacy policies
8.6 User Content Disclaimer
- We do not monitor, verify, or validate user-generated Content
- We are not responsible for the accuracy, quality, or legality of user Content
- We do not endorse any views, recommendations, or advice in user Content
- Users are solely responsible for their Content
9. Indemnification / Te Whakamahi Tuku
You agree to indemnify, defend, and hold harmless MyMate Limited, its directors, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of MyLog
- Your violation of these Terms
- Your Content or information you post
- Your violation of any third-party rights
- Your violation of any applicable laws
- Your failure to obtain proper consent or authorization
- Any negligent or wrongful conduct by you
This indemnification obligation survives termination of your account.
10. Privacy and Data Protection / Te Tūmataiti me te Tiaki Raraunga
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

- We comply with the Privacy Act 2020
- We implement reasonable security measures to protect your data
- Your data is stored in Canada (see Privacy Policy for safeguards)
- We do not sell or share your data for marketing purposes
- You have rights to access, correct, and delete your information

11. Termination and Suspension / Te Whakakore me te Whakatārewa
11.1 Termination by You
You may terminate your account at any time as described in Section 4.5.
11.2 Termination or Suspension by Us
We reserve the right to suspend or terminate your account immediately, without notice, if:
- You violate these Terms of Service
- You violate our Privacy Policy or Acceptable Use provisions
- You engage in fraudulent, abusive, or illegal activity
- Your account poses a security risk
- Your payment fails repeatedly
- We are required to do so by law or legal process
- We discontinue the MyLog service (with reasonable notice)
Consequences of termination:
- Immediate loss of access to your account and all Content
- No refund of subscription fees (except as required by consumer law)
- Permanent deletion of all diary entries and photos within 30 days
- Termination does not relieve you of obligations incurred before termination
11.3 Effect of Termination
Upon termination by either party:
- Your license to use MyLog immediately ends
- Sections of these Terms that by their nature should survive will survive (including indemnification, limitations of liability subject to consumer law)
- We will process data deletion as described in our Privacy Policy
- You remain liable for any outstanding fees or obligations
12. Modifications to Service and Terms / Ngā Panoni ki te Ratonga me ngā Ture
12.1 Changes to MyLog Service
- We may modify, suspend, or discontinue any aspect of MyLog at any time
- We may add or remove features without notice
- We may limit certain features to specific subscription tiers
- We will provide reasonable notice for material changes that significantly affect service functionality
12.2 Changes to These Terms
- We may update these Terms from time to time
- Changes will be posted on this page with an updated “Last Updated” date
- Material changes will be notified via email at least 30 days in advance
- Continued use after changes constitutes acceptance
- If you do not agree to changes, you must stop using MyLog and terminate your account
13. Dispute Resolution and Governing Law / Te Whakatau Tautohetohe me te Ture Whakahaere
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles.
13.2 Jurisdiction
Any disputes arising from these Terms or your use of MyLog shall be subject to the exclusive jurisdiction of the courts of New Zealand. You consent to the jurisdiction of these courts and waive any objections to venue.
13.3 Dispute Resolution Process
If you have a dispute with us, you agree to follow this process:
Step 1: Informal Resolution (Required First Step)
- Contact us at info@mylog.co.nz
- Provide a detailed description of the issue
- We will attempt to resolve informally within 30 days
- Most disputes can be resolved this way
Step 2: Mediation (Optional)
- If informal resolution fails, either party may request mediation
- Mediation will be conducted in Auckland, New Zealand
- Parties will share mediation costs equally
- Mediation is non-binding but encouraged
Step 3: Disputes Tribunal (For Claims Under $30,000)
The Disputes Tribunal is a quick, low-cost way to resolve disputes:
- No lawyers required
- Informal process
- Binding decisions

- Cost: $45-$200 depending on claim value
Step 4: Court Proceedings (Last Resort)
- Only after exhausting Steps 1-3 (or if urgent relief is needed)
- Actions must be brought in New Zealand courts
- Each party bears its own legal costs unless court orders otherwise
13.4 Resolving Disputes Early
We encourage you to raise concerns promptly so we can address them effectively.
Early Notification Benefits:
- Allows us to investigate while information is fresh
- Enables faster resolution
- Helps us improve our service
Your Legal Rights:
However, early notification does not affect your legal rights. Your legal rights are governed by statutory limitation periods:
- Contract claims: 6 years (Limitation Act 2010)
- Negligence claims: 6 years (Limitation Act 2010)
- Personal injury claims: Generally 3 years (with extensions available)
- Consumer protection claims: As provided by applicable law
Nothing in these Terms shortens these statutory periods.

15. General Provisions / Ngā Whakaritenga Whānui
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyMate Limited regarding MyLog and supersede all prior agreements and understandings.
15.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
15.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
15.4 Assignment
- You may NOT assign or transfer these Terms or your account without our written consent
- We MAY assign these Terms to any successor or affiliate without your consent, provided such assignment does not materially diminish your rights under consumer law
15.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and MyMate Limited.
15.6 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
15.7 Notices
Notices to You:
- We may provide notices via email to your registered email address
- Notices via email are deemed received 24 hours after sending
- You are responsible for keeping your email address current
Notices to Us:
- Must be sent to: info@mylog.co.nz
15.8 Export Control
You agree not to export, re-export, or transfer MyLog or any technical data in violation of any applicable export control laws or regulations of New Zealand or any other jurisdiction.
15.9 Survival
Sections of these Terms that by their nature should survive termination will survive, including: Intellectual Property, Indemnification, Dispute Resolution, Limitations of Liability (subject to consumer law), and General Provisions.
